Heard.
While deciding First Appeal No.579 of 2007 on 01.03.2019, it was directed that the appellant no.3 would be entitled to withdraw Rs.60,000/- provisionally. The remaining amount was directed to be transferred to the Reference Court depending upon the final adjudication of those proceedings.
It is informed that the appellant no.3 has received an amount of Rs.60,000/-. However the balance amount is still not received. By the order dated 08.04.2022 the Office was directed to file report as to whether any balance amount of compensation was lying with this Court or whether it has been sent to the Reference Court. As per the report an amount of Rs.60,000/- has been withdrawn by the appellant no.3 on 02.07.2019 and the balance amount has been transferred to the Reference Court. In view of aforesaid, as the Reference Court has decided the proceedings in L.A.C.No.8 of 2005 on 30.11.2019, the parties are free to execute that order and recover the amount determined by the Reference Court respectively.
The civil application stands disposed of.
