Apprehending the arrest at the hands of police, in connection with Crime No.87/2024 registered with Police Station Ashti, District Gadchiroli for the offences punishable under Sections 65(a), 83 and 98(2) of the Maharashtra Prohibition Act, 1949, the applicant approached this Court for grant of pre-arrest bail. 2.

Heard learned Counsel for both the parties.

Perused the investigation papers from which it reveals that the Investigating Officer has received the secret information that some persons are transporting the illicit liquor, and therefore, they conducted the raid, and two co-accused were arrested at the spot along with the stock. During interrogation with the arrested accused, the name of the present applicant was revealed, and therefore, he is arraigned as an accused. Thus, it is apparent that on the basis of the statement of the co-accused, the name of the present applicant is implicated. As far as his custodial

28.aba.600.24.odt interrogation is concerned, he is attending the police station since he has protected by this Court by granting ad-interim protection. The entire stock is already recovered. Considering the same, the applicant has made out a case for grant of anticipatory bail. In view of that, the interim protection granted to the applicant deserves to be confirmed.

Hence, the application is allowed. The interim protection granted to the applicant vide order dated 19/08/2024 is hereby confirmed on the same terms and conditions.

The applicant shall attend the concerned police station as and when required for the investigation purpose and shall cooperate with the investigating agency, till filing of the charge-sheet.

The application stands disposed of accordingly.
