This is the second round for seeking the relief of pre-arrest bail.
The first application for anticipatory bail filed on behalf of the present applicant was registered as Criminal Application [ABA] No. 300 of 2015 and this Court on 23rd July, 2015 [Coram : P.B. Varale, J.] dismissed the said application. Being dissatisfied by the said order, the applicant approached the Hon'ble Apex Court for the said relief. However, he could not get any order from the Hon'ble Apex Court.
Thereafter, the present application is filed on the ground that there is a change in circumstance - in the sense, according to learned counsel for the applicant, the other accused persons are granted anticipatory bail by this Court on 17th August, 2015.
The case of the present applicant is on the different footing than those persons who are granted anticipatory bail by this Court on 17th August, 2015. In that view of the matter, only because the other coaccused are granted bail, that cannot be the change in circumstance, especially when their case is not of identical nature.
Further, this Court on the earlier occasion, while deciding the first application filed on behalf of the present applicant, has evaluated the entire prosecution case and rejected his application. In that view of the matter, no case is made out. The application is rejected. Interim order granted in favour of the applicant on 14th September, 2015 stands vacated.
