Adjournment is sought on behalf of the appellant on the ground that the learned counsel Shri S.D. Deshpande is not well.

However, perusal of the application, which incidentally has not seen the light of the day since 2012, would reveal that stay is sought to the judgment and decree passed by the District Judge - 10, Nagpur in Appeal 139 of 2005 by and under which the appeal is dismissed. The application is misconceived and is rejected.
