Shri H.D. Dubey, learned Additional Public Prosecutor has placed on record letter dated 21/01/2021 of Assistant Police Inspector and Police Station Officer, Jalamb Police Station alongwith copy of death certificate of the appellant. As per the death certificate, the appellant expired on 29/04/2013. The learned Advocate appointed to represent the appellant through the High Court Legal Services Sub-committee, Nagpur has also filed the pursis bringing the said fact on record.

In that view, the appeal abates in terms of Section 394 of the Code of Criminal Procedure and accordingly disposed of.

The fees of the learned Advocate for the appellant is quantified at Rs 2,000/-. The legal aid authority shall pay the same to the learned advocate for the appellant within a period of four weeks. JUDGE J.Pethe..
