The application is for seeking relaxation of condition of bail.

This Court while releasing the applicant on bail in Criminal Application (BA) No.1170/2021 considered the material against the present applicant and also considered the rigor under Section 21(4) of the Maharashtra Control of Organized Crime Act (MCOC Act) and released him on bail. But considering that there are reasonable ground, he is released on bail by imposing the conditions that he shall attend the concerned Police Station on every 1st and 16th day of each month between 10.00 a.m. to 12.00 noon, till the culmination of trial. The intention behind imposing the condition is to secure the presence of the applicant. Only because the applicant has to attend from Mumbai cannot be a reasonable

(2) 9.appp.1362.2023 ground to cancel the condition, but it can be modified to the extent that the applicant shall attend the concerned Police Station on every 1st day of each month between 10.00 a.m. to 12.00 noon, till the culmination of trial. 3.

In view of that, the application is partly allowed with direction that the applicant shall attend the concerned Police Station on every 1st day of each month between 10.00 a.m. to 12.00 noon, till the culmination of trial.
