DATED : JUNE 20, 2022 By this petition, the petitioner challenged the order passed on the application under Section 36(I)(A) of the Maharashtra Public Trusts Act, refusing to grant permission to sell the property of the trust. 2.

Due to passage of time, the circumstances in relation to the need of the trust would change. Therefore, Advocate for the petitioner, on instructions from the petitioner, seeks permission to withdraw the petition with liberty to file an application under section 36(I)(A) of the Maharashtra Public Trusts Act, afresh.

Permission is granted.

In the event such an application is filed, the learned Charity Commissioner shall decide the said application on its own merit, uninfluenced by the order impugned in the present petition.

With such a clarification, the writ petition is disposed of.
