By this writ petition, the petitioner has challenged the seniority list prepared by the respondent nos.2 and 3, dated 24.09.2010. The petitioner has sought a direction against the respondents to prepare a fresh seniority list by considering the date on which the Assistant Teachers had secured the B.Ed. qualification.

Shri Rode, the learned Assistant Government Pleader appearing on behalf of the respondent no.1, states that the issue involved in this case was also involved in a bunch of writ petitions bearing Writ Petition Nos.2280 of 1997, 4185 of 2012 and others, and this Court has, by the judgment dated 28.07.2016, dismissed the said writ petitions in which a similar challenge was made to similarly prepared seniority list.

In view of the statement made by the learned Assistant Government Pleader and on a perusal of the judgment dated 28.07.2016 in the bunch of writ petitions bearing Writ Petition Nos.2280 of 1997, 4185 of 2012 and others, the writ petition is liable to be dismissed.

Hence, for the reasons recorded in the judgment dated 28.07.2016 in the bunch of writ petitions bearing Writ Petition Nos.2280 of 1997, 4185 of 2012 and others, we dismiss this writ petition with no order as to costs. JUDGE JUDGE APTE
