Relying upon the order dated 1-7-2017 accommodating certain persons in the matter of promotion and posting as Administrative Officer, Shri Pathak, the learned counsel appearing for the petitioner, has urged that the case of the petitioner can also be considered sympathetically.

The petitioner is promoted as Administrative Officer and posted at Mumbai. He has certain difficulties to join the place at Mumbai. He has given certain choices at Nagpur, Amravati and Nanded. It is open for the respondents to consider the posting of the petitioner at the places other than the place at Mumbai if the vacancy is available in the post of

Shri Thakur, the learned counsel appearing for the respondent No.4, seeks time to take instructions in the matter.

Put up the matter on 5-2-2019.

Needless to say that we have not yet gone into the merits of the matter, but we are trying to find out whether the matter is amicably settled."

The learned counsel for the respondent No.4 seeks two weeks' time in this matter to consider the case of the petitioner in respect of the post of Administrative Officer and pass appropriate order.

We grant three weeks' time to the respondent No.4 to take decision in the matter and communicate it to the petitioner. The petition stands disposed of.

All questions are left open.
