We have heard Mr. Joshi, learned counsel appearing for the petitioner for sometime.

Challenge in the petition is based on impermissibility of clubbing of various works in the matter of execution of Cement Concrete Road Project.

Mr. Dhatrak, learned counsel for the respondent no.1-Municipal Council, has invited our attention to the order of this Court dated 19.08.2024 passed in Writ Petition NO. 4795 of 2024 (M/s. Krushna Buildcon, Gondia vs. Municipal Council, Gondia and anr.) by stating that the issue sought to be canvassed in this writ petition is already looked into and decided on 19.08.2024 in M/s. Krushna Buildcon (supra).

We have perused the order dated 19.08.2024 in Writ Petition No. 4795 of 2024 in the background of the challenge raised in the petition.

We are of the view that the issue raised in this petition is already looked into and appreciated by this Court in M/s. Krushna

That being so, we see no reason to cause interference. The writ petition stands dismissed. No costs.
