DATE : 04/09/2023 Apprehending his arrest the applicant has filed the present application seeking anticipatory bail in connection with Crime No.265/2023, registered at Police Station Ramdaspeth, Akola for the offence punishable under Section 7, 7A read with Section 12 of the Prevention of Corruption Act, 1988.

Heard learned counsel for the applicant, as well as learned APP for respondent State.

It is the allegation that co-accused Nasir Khan Munaf Khan demanded Rs.8000/- for the applicant and Rs.2000/- for himself for taking entry of sub-division of a plot in the records, which was purchased by the complainant. On 13/01/2023, it also got confirmed from the applicant. However, KOLHE

2 / 2 26-ABA 566.2023 when the trap was conducted, the co-accused did not accept the bribe amount and trap was failed. On the complaint, said offence came to be registered against the applicant and co-accused. The other co-accused is arrested and released on bail.

Since the material part of the investigation is already over. Nothing is to be recovered from the applicant. During the pendency of the application, the applicant appeared before the Investigating Officer. It is reported that the voice samples of the applicant has already been recorded for the investigation purpose.

In view of the above, a case is made out by the applicant for granting anticipatory bail. Hence, I proceed to pass following order :-

ORDER

(a) The present application is allowed.

(b) The interim order dated 21/08/2023, is hereby confirmed.

(c) The applicant shall attend the office of Anti Corruption Bureau, Akola, as and when directed by the Investigating Officer and co-operate in the investigation.
