Heard Mr. Naik, learned Senior Advocate for the petitioner and Mr. Chauhan, learned Government Pleader/Senior Advocate for the respondent/State. 2.

The learned Government Pleader makes a statement that the respondents have already kept one post vacant for the petitioner as the enquiry is pending against the petitioner.

He further submits that though the Departmental Promotion Committee (DPC) was conducted, it will take some time to finalize the promotions. He further submits that a decision, on the report submitted to the Government as regards the enquiry conducted against the petitioner, will be taken within a period of four weeks.

In that view of the matter, we dispose of the present petition by accepting the statement made by the learned Government Pleader, referred herein above, with liberty to nd.thawre
