The applicant is arrested in Crime No.0922/2024 registered with Police Station, Awdhutwadi District Yavatmal for the offences punishable under Sections 420, 406, 409, 417, 418, 421, 424, 467, 468, 471, 477-A read with Section 120-B of the Indian Penal Cde and Section 3 of the Maharashtra Protection of Interest of Depositors act, 1999.

The applicant was working as a clerk in the Babaji Date Mahila Sahakari Bank since 1997 and was working as a Branch Manager since 2012. She was promoted and was working on various posts. Twelve persons are made accused in this case for misappropriation and cheating.

The learned Counsel for the applicant has stated that out of twelve persons, eleven are released on bail. The applicant was working as a Branch Manager from 27.08.2014 and thereafter, again she was reverted and working as a Junior Clerk. The allegations are that her signature is on two loan proposals. All the other accused are already released on bail. The custody of this applicant is not required. Hence, prayed to release the applicant on bail.

The learned A.P.P. opposed the application stating that, many persons are duped. The applicant was working on various posts. It was reveal during the investigation that the applicant has signed loan papers. Though the two loan papers bears her signature, her custody is required, hence, prayed to reject the application. 6.

Heard both the learned Counsel for the respective parties.

It appears from the record that, the period of this applicant as a Manager is only for one year. Thereafter again she was reverted and working as a Junior Clerk. Though she was working since 1997, considering her period as Manager of one year and only two loan papers she has signed allegation about misappropriation of huge amount. As all the other co-accused are already released on bail, on the ground of parity, the applicant deserved to be released on bail. Accordingly, I proceed to pass the following order :

i] The criminal application is allowed.

ii] The applicant shall be released on bail in connection with Crime No.0922/2024 registered with Police Station, Awdhutwadi District Yavatmal for the offences punishable under Sections 420, 406, 409, 417, 418, 421, 424, 467, 468, 471, 477-A read with Section 120-B of the Indian Penal Cde and Section 3 of the Maharashtra Protection of Interest of Depositors act, 1999, on furnishing P.R. Bond of Rs.25,000/- with one solvent surety in the like amount.

3 27.ba.873.25 iii] The applicant shall not in any way tamper with the prosecution evidence.

iv] The applicant shall not pressurize or threaten the prosecution witnesses.

v] The applicant shall attend the concerned police station whenever called by the Investigating Officer.

vi] The applicant shall co-operate the Investigation Officer.

The Criminal application is disposed of accordingly.
