The Petitioner, an Educational Institute, had applied for recognition to D.Ed. Course, which was rejected by the impugned order dated 11 May 2009. By way of amendment, the order dated 11 May 2009 for not to process the application further and to close the same was also challenged. The reply-affidavit has been filed by the Respondent No.2.

In this Petition, Rule was issued on 10 June 2010. No interim relief was granted. In the last 12 years, the Petitioner could have applied again or chosen not to apply, and none of these Lanjewar

232-wp-83-2010.odt developments are placed on record. The reply indicates the factors which were present at the time of passing the order. Even those factors must have undergone a change. In light thereof, no purpose will be served in keeping this Petition pending. If the Petitioner is desirous again to initiate a proposal, it is open to the Petitioner to do so and to the Respondents to consider it on its own merits. 3.

The Writ Petition is accordingly disposed of. Rule is discharged.
