Mrs.N.R. Tripathi, A.P.P. for the respondents. CORAM : SMT. VASANTI A NAIK AND M.G. GIRATKAR, JJ.

DATE : SEPTEMBER 28 , 2017.

The only prayer made by the petitioner in the instant petition is for a direction to the respondents to release the petitioner on parole for the treatment of his mother. We were not inclined to grant the relief in favour of the petitioner as the mother of the petitioner was ill in the year 2015 and the parole leave was sought two years earlier. However, since the learned Additional Public Prosecutor states that in view of the prayer made by the petitioner, the petitioner was released on parole on two occasions, i.e. in the years 2015 and 2017, the cause for filing the writ petition would not survive. The writ petition is, therefore, disposed of with no order as to costs.

The professional fees of the counsel for the petitioner are quantified at Rs.1,500/-.
