Heard the learned Counsel for the applicant/ respondent Nos.1 to 4 and the learned A.G.P. for the appellant. None for respondent No.5.

This application is signed by respondent No.1, although filed on behalf of all the claimants, who are major. Considering the grounds of appeal, I am of the view that respondent No.1 be permitted to withdraw, at this stage, an amount of Rs.4,00,000/- against her furnishing an undertaking to the effect that in the event of any adverse order being passed, she shall refund this amount together with accrued interest within four weeks from the date of such an order. Undertaking to be furnished within four weeks from the date of the order.

The civil application is allowed and disposed of with liberty to the remaining respondents to file fresh application for withdrawal.
