The applicant, who is the husband of the complainant, filed this application under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in Crime No.240 of 2021, registered on 04/10/2021 for the offence punishable under Section 498-A and 34 of the Indian Penal Code.

The complainant has alleged ill-treatment at the hands of the applicant and other two accused persons on various grounds including demand of money. 3.
I have heard the learned counsel for the applicants and the learned A.P.P. for the non-applicant/ State.

Mrs Taiwade, learned counsel appearing for the applicant states that this is a matrimonial matter and the allegations made in the complaint are exaggerated one. It is submitted that the complaint was lodged four months
2 aba808-21 after the complainant left the house of the applicant. She, therefore, states that the applicant is falsely implicated in the alleged offence. Accordingly, she prays for confirmation of ad-interim protection granted by this Court vide order dated 30/11/2021.

Shri V.A.Thakre, learned APP has made available the Police Diary for perusal and from the Police Diary he has pointed out that sufficient material is collected by the Investigating Officer against the applicant. Accordingly, he prays for rejection of the present application.

On perusal of the Police Diary, it is revealed that sufficient material has been collected against the applicant and there was a complaint made by the complainant even prior to lodging of the FIR, wherein she has narrated numerous instances of ill-treatment at the hands of the applicant, in detail. Looking to the allegations, which are serious in nature, I am not inclined to allow this application.
The application is rejected.
