Learned advocate for the petitioner submits that the Court has not given direction to the petitioner to deposit any amount. The warrant was cancelled subject to costs of 100/-. ₹ The learned advocate further submits that the accused under fear of arrest he made a statement before the learned Magistrate that he is ready to deposit 10,000/- and pay the ₹ remaining amount by 26.09.2022.

It is seen that the learned Magistrate has not issued any direction for the deposit of the amount. Similarly, the learned Magistrate has not stated that the deposit of 10,000/- and ₹ the remaining amount would be a condition precedent for cancellation of the warrant.

The learned advocate for the petitioner seeks leave to withdraw the petition.

It is made clear that if the petitioner succeeds in the criminal trial then the amount of 10,000/- shall be refunded ₹ to him. If he does not succeed, then the said amount shall be adjusted against the amount of compensation or fine amount according to law.

In view of the above, the petition stands disposed of as withdrawn.
