The applicant is arrested in connection with Crime No.462/2024 registered at Police Station, Sindewahi, District Chandrapur for the offences punishable under Sections 64(2)(m), 333, 351(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 4 and 6 of the Protection of Children from Sexual Offences Act, 2012.

It is alleged that the victim, who is 14 years of age was alone in her house. The applicant entered the house of the victim for giving marriage card and, thereafter, he had forcible sexual relations by gagging her mouth. Thereafter, the mother of the victim came to know about the incident when the victim became pregnant and she disclosed about it. The victim had delivered a baby. As per D.N.A. report, the applicant is the biological father of the said baby.

The learned Counsel for the applicant has stated that it was out of love affair.

The learned Counsel for the victim has stated that, the applicant is a married person, there is no question of love affair. The story narrated by the victim is about

Considering the prosecution case and as the applicant is proved to be a father of the child, the application is rejected.
