This is an application for grant of Leave to file an Appeal against Acquittal challenging the Judgment and Order dated 5th August, 2014 passed by learned Judicial Magistrate First Class [Court No.7], Amravati, in Summary Criminal Case No. 2905 of 2009, whereby the respondent no.1 is acquitted of the offence punishable under Section 138 of the Negotiable Instruments Act. Heard Mr. H.M. Sakhare, learned counsel for the applicant.
The Farad order shows that the respondent no.1 is served long back. In fact, on 27th January, 2015, there was no representation on the part of respondent no.1. However, in order to give one opportunity, this
Court granted time to the respondent no.1.
Today, when the matter was called, there is no appearance on the part of respondent no.1.
Hence Leave to file appeal is granted.
