On 30th August, 2023, the following order was passed :
"On previous date, the learned counsel sought time to take instructions as to whether to withdraw the application.
The learned counsel submits that she will take a chance to convince the Court.
The applicant has not placed on record the cross-examination of the applicant to test perversity in the findings recorded by the Family Court.
Learned counsel seeks time to place on record copy of the cross-examination. Stand over to 13.09.2023."

Thereafter, on 4th October, 2023, the following order was passed :
".
One more opportunity is given to comply the order dated 30/08/2023, failing to do so, the Application shall render as dismissed, without further reference to this Court."

The remark of the Registry indicates that the Applicant has not filed copy of the cross-examination. If that be so, the Registry to explain as to why this application has been listed before the Court today, when on 4th October, 2023, a conditional order was passed that failure of Applicant to comply the order dated 30th August, 2023, would render the application as dismissed, without further reference to this Court. 5.
