The Petitioner has sought a direction to Respondent No.2 Scrutiny Committee to decide the pending caste claim. 3.

On last date the learned A.G.P. had sought time to take instructions as regards pendency of the caste claims before Rgd

Order 0405wp1149.22 Respondent No.2 Scrutiny Committee. Today learned A.G.P. states that instructions have been received from the Deputy Director of Scrutiny Committee, Nagpur that Petitioners' caste claim falls in education category and there are around 486 educational cases out of total 630 cases, pending before the Scrutiny Committee.

In view of this position, we are not inclined to issue a direction to the Scrutiny Committee and leave it open to the Petitioner to make an application to the Scrutiny Committee to take up his application out of turn. It is for the Scrutiny Committee to take a decision thereupon as to whether priority needs to be given to Petitioners' caste claim keeping in mind the pendency.
