DATED : AUGUST 28, 2019 Heard Mr. Gandhe, learned counsel for applicant and Mr. Doifode, learned A.P.P. for non applicant-State. Also, perused reply filed on behalf of the prosecution. This application for regular bail is primarily opposed by learned A.P.P. on the ground that investigation is in progress and charge-sheet is yet to be filed. Applicant was working in the office of Gat Gram Panchayat, Samsherpur, Tq. Murtizapur, Dist. Akola. Anti Corruption Bureau, Akola laid a trap in view of complaint lodged by complainant Rajkumar Gowardhan Jamnik. The trap was successful when the applicant was found to be demanding and accepting the tainted amount of Rs.500/- from the complainant. The applicant is arrested on the very same day i.e. on 26.07.2019. From the reply, it is clear that though charge-sheet is not filed, entire investigation is over.

ba775.19.odt Applicant is in jail. He is a Government servant. Therefore, there is no possibility that he will not be available to the course of justice.

In that view of the matter, I pass following order.

ORDER

(i) The application is allowed.

(ii) Applicant-Janardhan Jayram Dhore be released on bail, in connection with Crime No.205/2019 registered with Police Station, Murtizapur, Dist. Akola for an offence punishable under Section 7 of the Prevention of Corruption Act, on he executing P.R. Bond in the sum of Rs.50,000/- with two solvent sureties in the like amount. (iii) Applicant is directed to attend office of Anti Corruption Bureau, Akola, twice a week i.e. on every Monday and Tuesday and shall be with investigating officer from 11.00 a.m. to 02.00 p.m., till filing of the charge-sheet. The application is disposed of.
