By the present application, the applicant is seeking interim relief in the nature of directions to the respondents restraining them from suspending or terminating the services of the petitioner. Writ Petition No. 5464/2015 is filed challenging the communication dated 19-6-2015.
It is the submission of the petitioner that he is the senior most Professor in the Institute and instead of appointing him as Officiating Principal, one Shri Baba Shambarkar is appointed as Officiating Principal. The issue of such claim of seniority is pending before this Court. The application is on the ground of apprehension of the petitioner/applicant in view of the communication issued by the institute. The communication is a show cause notice. The petitioner/applicant is at liberty to reply to such .....2/-
2 caw2003.15.odt notice. The petitioner/applicant is also at liberty to avail remedy if some order is passed in pursuance to the show cause notice and that too after hearing the applicant. Mere apprehension of the petitioner that too on the basis of show cause notice to which the petitioner has not replied so far cannot be a ground to grant interim relief as claimed by the petitioner. The application, being meritless, deserves to be rejected and the same is, accordingly, rejected. JUDGE wasnik ...../-
