The applicant seeks pre-arrest bail in the crime registered against him for the offences punishable under Sections 420, 467, 468, 471, 409, 120B read with Section 34 of the Indian Penal Code. Along with applicant there are two other co-accused i.e. (i) Assistant Registrar, Co-operative Societies and (ii) Talathi. The Assistant Registrar, Cooperative Societies is granted pre-arrest bail by this Court by order passed in Criminal Application (ABA) No. 568 of 2016 on 19th October, 2016. In this application also the applicant is granted interim protection by the order passed on 1st September, 2016.

In the reply filed by the non-applicant before this Court a general statement is made that the applicant is not co-operating with the investigation. Except for the general statement, nothing is brought on record to show that the custody of the applicant is necessary for further investigation. The reply is filed on 7th October, 2016 and the non-applicant

2 aba570.16 has not taken any steps to get the application heard and disposed of. The non-applicant has not pointed out that any departmental enquiry is initiated or proposed against other two co-accused who are government officers.

In the above facts, in my view, the interim order granted on 1st September, 2016 is required to be confirmed and it is confirmed accordingly.

The application is allowed.
