The applicant is apprehending her arrest in connection with Crime No.124/2019 registered with Ramnagar Police Station, District Chandrapur for offences under Sections 65E and 83 of the Maharashtra Prohibition Act, 1949 and under Section 188 of the Indian Penal Code.

Heard learned counsel Shri M.N.Ali for the applicant and learned Additional Public Prosecutor Shri V.A.Thakare for the State. Also, perused reply filed on behalf of the State. 3.

As per reply, on 31.1.2019, Ramnagar Police Station, District Chandrapur, received a secret information that accused persons are unloading foreign liquor and country liquor at the house of the applicant. Accordingly, raid was made and contraband was seized. However, the raid made was after sunset and, therefore, the applicant being a lady and though she was present in the police station, she was not arrested. Though she was called in the police station, she did not attend.

Custodial presence of the applicant is claimed for the purposes of interrogation.

The contraband is already seized. The applicant being a lady and having no criminal antecedents, in my view, she can be granted anticipatory bail on some conditions. Hence, I pass following order:

ORDER

(i) The criminal application is allowed.

(ii) In the event of arrest of applicant-Rukhsat Riyaz Sheikh, in connection with Crime No.124/2019 registered with Ramnagar Police Station, District Chandrapur for offences under Sections 65E and 83 of the Maharashtra Prohibition Act, 1949 and under Section 188 of the Indian Penal Code, the applicant be released on bail on she executing a P.R.Bond in the sum of Rs.50,000/- with one solvent surety of the like amount.

(iii) The applicant shall attend the police station from 8.9.2019 to 15.9.2019 and shall be with Investigating Officer from 11:00 a.m. to 3:00 p.m..

(iv) With this, the criminal application stands disposed of accordingly.
