Considering the facts of the case, the respondent No.1/claimant is permitted to withdraw Rs.8,00,000/-. In addition, the respondent No.1/claimant be given Rs.8,00,000/- on furnishing solvent surety/security to the satisfaction of the Registrar (Judicial) of this Court and an undertaking to the Registrar (Judicial) of this Court stating that if it is found that the claimant is not entitled for the amount withdrawn by him, he will redeposit it with the Registry of this Court along with interest as may be determined, within two months. The amount be transmitted in the account of the respondent No.1/claimant after the claimant furnishes surety/security and the undertaking as above.

The balance amount be continued in fixed deposit till disposal of the appeal.

The civil application is allowed in the above terms.
