IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR.

CAW NO. 1823/2017 IN WRIT PETITION NO. 4704 OF 2017 (Samiksha d/o Raju Dhole & Anr. vs. Union of India thr. its Ministry of Health and Family Welfare & Ors.) _____________________________________________________________________________ Office Notes, Office Memoranda of Coram, appearances, Court's orders or directions Court's or Judge's orders.

and Registrar's Orders.

CORAM : B.P. DHARMADHIKARI & ARUN D. UPADHYE, JJ.

AUGUST 11, 2017.

Heard Shri R.V. Malviya, learned counsel for the applicants/ petitioners, Shri A.M. Aurangabadkar, learned counsel for respondent No. 1 and Mrs. B.P. Maldhure, learned counsel for respondent Nos. 2 to 4.

2.

By a reasoned judgment, this Court has yesterday dismissed Writ Petition No. 4704 of 2017. We have found that five years continuous status as insured person must be possessed as on 01.01.2017. Thus, status must be continuous and in writ petition, there is a break in that status in the year 2016.

3.

We have accepted the computation of Respondent Nos. 2 to 4 as given by them in paragraph 5 of their reply affidavit.

4.

Considering the fact that admissions are to M.B.B.S. Course and need to be processed in time bound manner, we are not inclined to extend interim order. Civil Application is rejected. No costs.
