The anticipatory application of the appellant having been rejected by the learned Sessions Judge, Washim by its order dated 14.08.2023 in Crime No.232/2023 registered with Police Station, Ansing, District Washim for the offences punishable under Sections 294, 323 and 506 of the Indian Penal Code and under Sections 3 (1)(r), 3(1)(s), 3(1) (f) and 3(1)(f) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989, the present appeal came to be filed.

Learned APP, on instructions from Shri Arjunsingh Rajput, the Investigating Officer, who is present in the Court, submits that custody of the appellant is not required and he is going to issue notice under Section 41A of the Code of Criminal Procedure to the appellant.

In view of submission made by the Investigating Officer nothing survives in the appeal. Accordingly, the appeal is disposed of as infructuous.
