O R D E R
(Passed on 13th August, 2022) Vanita wd/o Chandrakant Ghangare is personally present before the Panel and she has been identified by her counsel. Shri Amit Mategaonkar, learned Advocate, is present for the respondent No.2/Insurance Company. Saraswati wd/o Tulsiram Ghangare/Appellant No.2, who was dependent of the deceased, she died during the pendency of the present appeal.
Both the parties have confirmed that the matter has been amicably settled between them and thereby, the respondent No.2/Insurance Company has agreed to pay additional amount of Rs.4,75,000/- towards full and final settlement within the period of 60 days from today. The settlement arrived at between the parties is on the following terms:
"The present appeal is settled between the appellant and the Insurance Company/Respondent No.2 on the condition that the insurance company agrees to pay the additional amount of Rs.4,75,000/-(Four Lakhs Seventy Five thousand only) towards full and final settlement within the period of 60 days from the date of award, failing which Insurance company agrees to pay the interest of 7.5% p.a. from the date of award till realization of the amount. Appellant No.2 died during pendency of the present appeal therefore, her share may be given to appellant No.1 & 3. The appellant No.3 is being minor through her natural guardian appellant No.1 (mother)." Accordingly, the appellants do not want to proceed further. In view of that, settlement is accepted. The appeal is disposed of as settled.
Court fee, if any, be refunded as per Rules.
On deposit of amount of compensation as per the settlement by the Insurance Company, the appellants are permitted to withdraw the same. Pending application(s), if any, shall stand disposed of.
