DATED : July 05, 2019 In the light of notice for final disposal issued earlier, learned counsel for the parties have been heard.

The only prayer made in the present writ petition is to direct the appellate Court to decide the proceedings in Misc. Civil Appeal No.5/2013 expeditiously.

According to the petitioner, in the suit filed by the respondent no.1 the trial Court allowed the application for temporary injunction by its order dated 13.08.2012. This order was challenged in the aforesaid Misc. Civil Appeal. It is stated that the said appeal is pending since the year 2012 as the regular Court was not available. It is thus prayed that the proceedings in Misc. Civil Appeal are expedited. On behalf of the respondent no.1, it is submitted that the proceedings in R.C.S.No.103/2013 have been expedited. That suit is however still pending before the trial Court.

WP5661.18 2/2 Considering the fact that the Misc. Civil Appeal is pending since the year 2012, the same is directed to be decided expeditiously on its own merits within a period of three months from today. With these directions, the writ petition stands disposed of. No costs. JUDGE Andurkar.
