Shri Deshpande, the learned Additional Government Pleader, states that during the pendency of the writ petition, the final development plan has been published and in view of the subsequent development, the challenge made by the petitioner in the instant petition would be rendered infructuous. Mrs. Sirpurkar, the learned counsel for the petitioner, states that the petitioner is desirous of withdrawing the writ petition in view of the subsequent development but in case the petitioner is desirous of challenging the subsequent action, the points raised in the writ petition may be kept open. The request made on behalf of the petitioner is just and reasonable. Hence, though we permit the petitioner to withdraw the writ petition, the points raised in the writ petition are kept open.
