Prayer is to condone delay of 43 days in filing the Second Appeal. In the application it is stated that the applicant was advised to go to Nagpur for filing Second Appeal and hence some time was required for arranging for court fees and other expenses.

Reply is filed on behalf of the respondent nos. 1 and 2 opposing application. It is stated that reasons as assigned are false and only to avoid refund of earnest money, the appeal has been preferred. Considering the reasons as stated by the applicant in paragraphs 5 and 6 of the application the delay in filing Second Appeal is condoned subject to costs of Rs. 1000/- to be paid to respondent nos. 1 and 2 within a period of three weeks from today.
