Prayer is to condone the delay in filing restoration application and for setting aside the order of dismissal dated 21.08.2013. The application is supported by affidavit filed by counsel for the applicant. Application is opposed by learned counsel for the respondent no.1 on the ground that applicant has not been diligent in prosecuting the appeal.

Considering the fact that the appeal was dismissed on 21.08.2013 and application for restoration has been filed almost after one year , for the reasons stated in the application the delay is condoned and appeal is restored to file subject to costs of Rs. 2000/- to be paid by applicant to the respondent no.1 within a period of four weeks from today. Applications are allowed and disposed of.
