Heard Mr. Bute, learned Counsel for the applicant and Mr. Sonak, learned A.P.P. for the non-applicant/State. The applicant is arrested in connection with Crime No.74/2015, registered with Police Station Paratwada, Districrt Amravati for the offences punishable under Section 302 and 201 of the Indian Penal Code.

The dead body of an unknown woman was found on 01/03/2015, who was identified as Shobhana. According to the prosecution case, the evidence against the present applicant is that the deceased was lastly seen in the company of the present applicant and a memorandum statement under Section 27 of the Evidence Act was recorded.

There is no eye-witness account. The entire case is based on the circumstantial evidence.

ba.707.15 2/2 In that view of the matter, when the charge-sheet is already filed, in my view, further custodial presence of the applicant is not required. Hence, the following order: 1.

The application is allowed.

Applicant-Wasudeo Ramdeo Dhikar be released on bail on he executing P.R. Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one solvent surety in the like amount in connection with Crime No.74/2015, registered with Police Station Paratwada, District Amravati for the offences punishable under Sections 302 and 201 of the Indian Penal Code before the Trial Court.

The applicant shall attend the Police Station twice in a month preferably on first and third Saturday in between 03:00 p.m. to 05:00 p.m., till culmination of the trial. 4.

With these, the application is disposed of.
