This is an application seeking substituted service by publication in newspaper.

Shri Kukday, learned counsel appearing for the Applicant/Appellant submits that the notice issued to Respondents No.5 and 6 has been received back unserved for want of correct address, although the Appellant has tried to ascertain the correct address of the said Respondents, however, no other address is available. He therefore requests that the substituted service be permitted.

Shri Joharapurkar, learned counsel appearing for Respondents No.1 to 4 has no objection.

Having heard the learned counsel appearing for the parties and having perused the application, the prayer for substituted service is hereby granted. Let the Respondents No.5 and 6 be served by substituted service by publication of notice in newspaper having circulation in the area where they were last known to reside.

Let the fresh notice be issued for the said purpose, returnable after three weeks. List the matter on 20.10.2022. 6.

The civil application accordingly stands disposed. 7.
