Perused the reply and the charge sheet.
The co-accused Firoz Akhtar, Sushil Dekate and Iftekhar Ahmad have already been released by this Court today. There are two more co-accused Ajay and Abdul, who have been released on bail on 18th August, 2016 (Criminal Application (BA) No.578/16) and 9th April, 2015 (Criminal Application (BA) No.143/15). This applicant stands even on better footing than all these co-accused and deserves to be released on bail as there has been neither any recovery of blood-stained articles or clothes from him nor has he been identified by Sonu or any of the petrol pump employees. Therefore, this applicant deserves to be released on bail. In the circumstances, I find that this application deserves to be allowed.
The application is allowed and it is directed that the applicant be released on bail on his furnishing a P.R. Bond in the sum of Rs.20,000/- together with one solvent surety in the like amount on the conditions that he shall attend the Court on the dates fixed in the matter, shall co-operate with
2 919.ba.762.16 the Court in expeditious disposal of the case and shall not tamper with the prosecution witnesses.
Hamdast granted.
