Heard learned counsel for the rival parties.
In Crime No.174/2014 for offence punishable under Sections 143, 147, 148, 307, 302 of the IPC along with Sections 4 and 25 of the Arms Act, registered at Ramdaspeth Police Station, Dist. Akola, the applicant was arrested on 20.11.2014 and since then is in jail.
Perused the police papers. From the perusal thereof, it is seen that the one Kapil had given blow on complainant by means of chopper. The other evidence shows that the injury caused by the chopper did not result into even a fracture. That being so, I think the applicant's detention in jail is unnecessary and not required. Learned counsel for the applicant undertakes that the applicant could be put to condition that he shall not enter Akola town till the trial is over and further undertakes that his client would not apply for modification of this condition. On this statement, the
14.01.ba.710.15 following order is passed:
ORDER
a) The applicant be released on bail on his executing PR bond in the sum of Rs.20,000/- (rupees twenty thousand ), with one solvent surety in the like amount.
b) The applicant -Shubham is prohibited from entering Akola town till the trial is over, except for attending the Police Station or the Court, as per the appointed dates and shall not apply for modification of this condition. The applicant-Shubham to inform the concerned Police Station where he would reside. c) The order as regards prohibition of applicantSubham not to enter Akola town, be informed by the concerned Police Station to the family of the complainant.
d) Criminal Application No. 710/2015 shall stand disposed of accordingly.
