DATE : 25.02.2015 Heard the learned Advocates for the respective parties. In Civil Application Stamp No.20282/2013, the appellant sought permission to amend the memorandum of appeal and the original reference application. This Court by the order dated 1.4.2014 allowed the civil application, however, it came to be recorded that the appellant is permitted to amend the memorandum of appeal. Civil Application No.1393/2014 is filed by the appellant praying that the error committed in the order due to inadvertence be corrected.
Considering the facts on the record, the prayer as made by the appellant is required to be granted.
The order passed by this Court on 1.4.2014 has to be read to mean that the appellant is permitted to amend the memorandum of appeal and also reference application. The civil application is allowed accordingly. JUDGE Wadkar
