Apprehending the arrest at the hands of police in connection with Crime No.254/2025 registered with Sadar Police Station, for the offence punishable under Sections 120-B, 409, 420, 465, 468, 471, 472 read with Section 34 of the Indian Penal Code, the applicant approached this Court for grant of pre-arrest bail.

Heard learned Counsel for the applicant who submitted that on 11.04.2025, one Munna Waghmare has lodged a report to the effect that he is acquainted with the teachers working in Nanaji Pudke Vidyalaya, Lakhani, District Bhandara. The informant came to know from the teachers that although Parag Nanaji Pudke i.e. co-accused has no experience of teaching, he became headmaster directly. The said
(2) 925.aba.562.2025 co-accused has obtained the false and bogus certificates purportedly prepared and issued by SKB Vidyamandir, Yadav Nagar, Nagpur. On the basis of the said false and bogus documents, the then Deputy Director of Education, Nagpur favoured him in creating various false and bogus documents. On the basis of false and bogus documents, the various persons were appointed as a teacher. As far as the allegation against the present applicant is concerned, it is to the extent that he has forwarded the proposal, which was put in the school committee meeting. Being a Secretary, he has put his seal and signature and forwarded the same and on the basis of the same, the Shalarth IDs were created and the pecuniary gains are received by the various teachers. 3.
Learned Counsel for the applicant submitted that as per the role of the present applicant is concerned, which is only to the extent of forwarding the proposal. Admittedly, the entire information was forwarded by the headmaster of the school. The role of the applicant is only to the extent of forwarding the said proposal by putting his signature in a school committee member. As far as his custodial interrogation is concerned, which is not required. In view of that, he be protected by granting anticipatory bail. He further submitted that no pecuniary gain is received by the present applicant.

Learned APP strongly opposed for the same on the ground that it was the present applicant considered the proposal without verifying the documents and thereby assisted the other accused in receiving the pecuniary gain. In view of that, the application deserves to be rejected.

After hearing both sides and on perusal of the investigation papers, limited role is attributed to the present applicant only to the extent of forwarding the proposal therefore, his custodial interrogation is not required. In view of that, the application deserves to be allowed. Accordingly, I proceed to pass following order:
ORDER
(i) The application is allowed.
(ii) In the event of arrest, in connection with Crime No.254/2025 registered with Sadar Police Station, Nagpur for the offence punishable under Sections 120-B, 409, 420, 465, 468, 471, 472 read with Section 34 of the Indian Penal Code, the applicant Dilip s/o Wamanrao Bansod shall be released on anticipatory bail, on executing PR Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
(iii) The applicant shall attend the concerned Police Station once in a week on Sunday between 10.00 a.m. to 1.00 p.m. and shall cooperate with the investigating agency.
(4) 925.aba.562.2025 (iv) The applicant shall not indulge in further forwarding any proposals for the purpose of the Shalarth ID.
(v) The applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the case.
The application is disposed of.
