In this petition, a prayer is made to direct the Chief Judicial Magistrate, Amravati, to decide the application filed by the petitioner under Section 14 of the Secularization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The petitioner is secured creditor, who has filed proceedings bearing OCMA No. 429 of 2024 dated 22/04/2024 under Section 14 of the said Act. According to him, the same is still not decided.

The learned counsel submits that the issue has been authoritatively decided by the Principal Seat, Mumbai in Writ Petition 15285 of 2022 dated 17/04/2023. He, therefore, states that the respondent be directed to decide the issue in accordance with the directions issued in the said judgment dated 17/04/2023. 4.

Considering the fact that the application filed under Section 14 of the Act 2002 dated 22/04/2024 is still not decided, we request Chief Judicial Magistrate, Amravati, before whom the said application rkn

wp6454.2025.odt is pending, to decide the same in the light of directions issued by this Court at Principal Seat, Mumbai, in Writ Petition No. 15285 of 2022 on 17/04/2023.
