Shri C.A. Joshi, learned counsel for the petitioner, Shri A.M. Kukday, learned counsel for respondent Nos. 1 to 3 and Mrs. K.S. Joshi, learned AGP for respondent No. 4.

We do not find it necessary to delve more on the merits of the controversy. The Registrar (Legal and Research), High Court of Bombay, has filed an additional affidavit vide Stamp No. 9834 of 2016 and in paragraph 2 thereof, leave has been sought to add paragraph Nos. 20, 21 and 22 in earlier reply already placed on record. The paragraphs sought to be added show possibility of accommodation of the petitioner at Akola, as the vacancies in the cadre of Lower Grade Stenographers are available at Akola. An undertaking has been sought from the petitioner and according the petitioner he has agreed to subject himself to the Rules of Inter District Transfer. Shri Joshi, learned counsel on behalf of the petitioner submits that vide additional affidavit filed vide Stamp No. 10148 of 2016 on 22.08.2016, the necessary

undertaking has been placed on record of writ petition. We grant the petitioner liberty to supply said undertaking on an affidavit to Respondent No. 1 within a period of two weeks from today. Respondent No. 1 shall thereafter examine the same and consider eligibility of the petitioner for Inter District Transfer to Akola, while filling in other vacancies as per law. This exercise shall be completed at the earliest.

In view of this liberty and order, writ petition is rendered infructuous and it is accordingly disposed of. No order as to costs.
