APRIL 17, 2017 Applicant claims that he is not responsible for drawing of the list in which names appear and for effecting the payments accordingly. The list was verified by the superiors and the amount is also released in the names of the individual beneficiaries through cheques by them. He points out that the amount was in fact deposited in their respective accounts.

In reply, the State Government has pointed out that after the amount was deposited in the accounts of ineligible beneficiaries, it was withdrawn by the present applicant.

Several disputed questions arise and in this jurisdiction, we are not inclined to go into it. We however take note of the fact that the applicant continues under suspension for about two years. We, therefore, direct the non applicants to

apl618.16.odt complete the investigation at the earliest and present the charge-sheet to the competent court within a period of three months.

Keeping all the contentions open, we dispose of the present application. No order as to costs. JUDGE JUDGE kahale
