By this petition, the petitioner has sought a direction to the respondents to pay the benefits of Senior Pay-scale to the petitioner with effect from 17.01.1990 and Selection Grade from 17.01.1998.

It is submitted that despite the judgment of this Court on similar issue, the respondents have not granted the benefit of Senior Pay-scale and Selection Grade to the petitioner with effect from 17.01.1990 and 17.01.1998 respectively.

Shri Kankale, the learned Assistant Government Pleader appearing on behalf of the respondent nos.1 to 3, states on the basis of the affidavit-in-reply filed on behalf of the concerned respondents that the judgment dated 11.03.1991, on which the petitioner relies, was not sent to the Government either by the petitioner or by the management. It is stated that the matter in respect of payment of Senior Pay-scale and Selection Grade to the petitioner with effect from 17.01.1990 and 17.01.1998 respectively, would be now placed before the committee for consideration. It is stated that after the committee's recommendations, the monetary benefits flowing from the grant of Senior Pay-scale and Selection Grade to the petitioner from the dates mentioned hereinabove, would be released within a period of three months.

WP5509-14 On the statement made by the learned Assistant Government Pleader, which would be binding on the respondent nos.1 to 3, we dispose of the writ petition with no order as to costs. JUDGE JUDGE APTE
