DATED : 17/09/ This application is filed on behalf of the claimants praying that the amount deposited with the Registry of this Court be given to them. The first appeal filed by the owner of the vehicle involved in the accident is dismissed for want of prosecution on 21/03/2017. There is nothing on record to show that the appellant has taken steps to get the first appeal restored. Though the name of the advocate who represented the appellant in the first appeal appears on record and the daily board, none appears for the appellant.

Though the learned advocate for the claimants sought time and showed inability to assist the Court, after examining the Roznama and the orders passed by this Court, the following order is passed:-

O R D E R

The amount deposited with the Registry of this Court in this first appeal alongwith interest, be given to the claimants as per the impugned award.

The civil application is allowed accordingly. No costs.
