By this petition, the petitioner seeks a direction to the respondent no.2 Municipal council to pay the amount towards leave encashment.
The learned counsel for the respondent- Municipal Council fairly states that an amount of Rs. 74,556/- is due and payable to the petitioner and the same would be paid to the petitioner within a period of six months in installments. It is stated that 42 retired employees have not been paid their dues though some of of them were retired in the year 2006. It is stated that the respondent -Municipal Council is desirous of making the payment, but could not pay the dues, due to financial problems. We dispose of the Writ Petition by accepting the statement of the learned counsel for the Municipal Council which would be binding on the Municipal Council.
