Learned counsel for the applicant submits that the order impugned is passed by the learned Assistant Sessions Judge, Nagpur. Therefore, revision lies before the learned Sessions Judge.

In that view of the matter, he submits that he wishes to withdraw the present revision application and he will be filing the revision before the Sessions Court.

The present revision application is disposed of with liberty to the applicant to file revision before the learned Sessions Judge. It is made clear that this Court has not heard the matter on merit.
