Learned A.G.P. waives notice for the added respondent.

The learned Counsel for the appellant does not press the appeal. In that view of the matter, the appeal is disposed of.

However, the respondent no.1 shall send a proposal for making pensionary benefits applicable to the petitioner and also for the other terminal benefits to which the petitioner is entitled to, as per the order passed by the learned Single

3.3lpa126.10 Judge. The same shall be done within a period of two weeks from today. After the receipt of the proposal, the respondent no.3 shall forward the same to the Accountant General, Maharashtra-II, Nagpur within a period of three weeks from the date of receipt of the proposal from the respondent no.1. Since now there are no proceedings pending, the Accountant General shall take appropriate decision and see to it that the pensionary benefits along with the arrears, if any, and the other terminal benefits are in fact paid to the petitioner. The same shall be done in any case within a period of three months from the date of receipt of the proposal by the Accountant General from the Education Officer.

Authenticated copy of the order may be supplied to the parties to act upon.
