Nobody is present for the applicant/ petitioner. I have heard Shri M.A.Vaishnav, learned counsel for the non applicants 1 and 2/respondent nos. 1 and 2 and Ms Shamsi Haider, learned AGP for non applicant no.3/respondent no.3.

This application seeking early hearing of the petition cannot be granted for the reason that the issue involved in the petition would have to be considered in the light of the Full Bench judgment of this Court rendered in the case of Ramkrishna Chauhan Vs. Seth D.M.High School reported in 2013(2) Mh.L.J. 713 and this judgment is under scrutiny for its correctness before the Hon'ble Apex

CAW2350.18 Court as pointed out by Shri Vaishnav, learned counsel for respondent nos. 1 and 2. He submits that he has tried to search on the Internet number of Special Leave Petition, but he was unable to obtain the same. However, at this stage, having regard to the submissions made across the bar, it may not be appropriate for this Court to fix the petition for final hearing. Therefore, the application is rejected with liberty to the applicant/petitioner to file similar application at appropriate time.

The application is disposed of accordingly.
