It is not in dispute that the petitioner has made representation as contemplated by sub-section (2) of section 207 of the Motor Vehicles Act against the seizure of the vehicle, however, it has not yet been decided. Hence, the prayer clause (ii) in the petition is to direct respondent No.3 to decide the application of the petitioner and release the vehicle.

In view of above, we partly allow this petition and direct respondent No.3 to decide the application/ representation of the petitioner made under sub-section

(2) of section 207 of the Motor Vehicles Act within a period of one month from today. The petition stands disposed of accordingly.
